Preamble
The website "mk2hotelparadiso.com" (hereinafter "the Site"), published by the company MK2 HOTEL (hereinafter "MK2"), is intended to provide information about our hotel establishment, HOTEL PARADISO, located at 135 boulevard Diderot 75012 PARIS (hereinafter "the Hotel"), and to allow for the online booking of rooms and additional services at the Hotel.
These general terms and conditions of use (hereinafter "TOU") govern access to and use of the Site by any person (hereinafter "User(s)"). The User agrees to comply with the TOU, which MK2 reserves the right to modify at any time. Users are therefore advised to regularly refer to the latest version of the TOU available on the Site.
The General Terms and Conditions of Sale (hereinafter "GTCS"), available in the footer of the Site, apply to anyone wishing to book room(s) and any additional services at the Hotel, in addition to the TOU.
1 – SITE ACCESSIBILITY
The Site is accessible from an internet-connected device. The User is solely responsible for the installation, operation, and maintenance of the technical equipment required to access the Site's features. MK2 shall in no way be held liable if the Site proves incompatible with or malfunctions on certain software, configurations, operating systems, or User equipment.
2 – PERSONAL DATA
Personal data that MK2 may collect and process in connection with any person's use of the Site is processed in accordance with the amended French Data Protection Act of January 6, 1978, and the European General Data Protection Regulation (GDPR) 2016/679 of April 27, 2016, and in compliance with the MK2 Group Privacy Policy: https://www.mk2.com/politique-confidentialite.

Any reservation confirmed on the Site implies the Client's full and unreserved acceptance of all terms regarding the processing of their personal data.
Processing of personal data for reservations made on the Site:
To manage and process reservations on the site, MK2 requires the client's name, email address, and payment details.
Optionally, and only if the client agrees to provide this additional information, MK2 may also collect the following data to contact the client more easily and/or offer a more personalized service: first name, phone number, nationality, and/or any additional information the client wishes to provide for their stay at the Hotel.
The data above is collected and processed in the context of the formation and performance of the contract between MK2 and the client, for the purpose of processing their order and for any related communications.
MK2 may also use this data within the context of the business relationship resulting from interactions with the client, and in MK2's legitimate interest to maintain an up-to-date database of its clients and prospects.
This personal data is intended for MK2 teams for the aforementioned purposes and, where applicable, for its subcontractors. It is retained for the duration necessary to fulfill the aforementioned purposes, as specified in the MK2 Group Privacy Policy: https://www.mk2.com/politique-confidentialite, within the limits of applicable statutory limitation periods. Data may be transferred outside the EU by MK2's subcontractors. MK2 ensures that all its subcontractors that transfer data outside the EU provide a level of data protection equivalent to that required by the GDPR.
Processing of personal data for HOTEL PARADISO Newsletter subscriptions:
To manage newsletter subscriptions, MK2 requires the email address of the person wishing to subscribe, which MK2 collects and processes based on the individual's consent.
The user's email address is intended solely for use by MK2 teams and its newsletter service provider for the purpose of sending MK2 newsletters. MK2 processes and retains the user's email address until they unsubscribe from the newsletter. You may unsubscribe at any time by clicking the link provided at the bottom of each newsletter email.

4 – INTELLECTUAL PROPERTY AND OTHER RIGHTS ATTACHED TO SITE CONTENT

User Obligations
Just as we are all expected to follow rules of conduct and courtesy in daily life, we ask all Users to do the same when using the Site.
In this context, the Site User agrees to comply at all times with the rules and obligations as described in the Terms and Conditions of Sale, and more generally with all obligations resulting from applicable French and/or international provisions.
Accordingly, the User makes the following commitments:
- To respect the rights of others of any kind, including personality rights (such as the right to one's image and the right to privacy) and intellectual property rights.
- To respect the image and reputation of MK2 and/or the MK2 group, as well as the individuals and works featured on the Site, and not to engage in any statements and/or actions that damage the image, reputation, or, more generally, the interests of MK2 and/or the MK2 group and/or the aforementioned individuals and works.
- Not to use the Site for purposes other than those for which it is intended, and in particular not to use it for commercial purposes or, more generally, to offer products and services that provide direct or indirect remuneration.
- Not to hinder or disrupt, in any way whatsoever, access to and/or the proper functioning of the Site.
- Not to violate or attempt to violate the security and/or integrity of the Site and/or all or part of its components (notably software).

Liability and Indemnification
The User is solely responsible for their use of the Site, their actions on the Internet, and more generally for compliance with these terms (and the Terms and Conditions of Sale) and applicable standards; MK2 shall in no way be held liable for any of the foregoing.
Consequently, the User shall take all necessary precautions, including:
- protecting and keeping their personal data and booking references confidential, and agrees not to disclose them in any form whatsoever.
- preventing any unauthorized use of their personal data and booking references or any other infringement
- protecting their data, software, and hardware against any viruses circulating on the Internet (notably by keeping their antivirus software up to date and avoiding downloading and/or opening documents and/or messages from dubious or unknown sources).
Furthermore, the User irrevocably agrees to indemnify and hold harmless MK2 and/or the MK2 group against any recourse, claim, or demand of any kind whatsoever (including any complaint or request from third parties) resulting from use of the Site that does not comply with these terms, or from any violation of the Terms of Use, Terms and Conditions of Sale, the rights of others, public order, or more generally any applicable standards. The User agrees to bear all related legal fees and costs, as well as any damages, including financial penalties, that may be awarded against MK2 and/or the MK2 group, without prejudice to any damages that MK2 and/or the MK2 group may claim.
MK2 disclaims all liability in the event of loss, theft, or unauthorized use of the User's personal data and booking references, as well as for any damage resulting from computer viruses and/or damage caused to their data, software, or hardware, or in the event of use of the Site and services that does not comply with these terms and the Site's Terms and Conditions of Sale, or use of the Site and/or services that violates applicable standards.
6 – WARRANTY – SITE AVAILABILITY
To ensure the smooth technical operation of the Site, Users must comply with certain technical constraints.
Due to the constant technical evolution of the Internet in this area, these constraints are subject to change during the term of this agreement.
MK2 strives to keep the Site accessible 24 hours a day, 7 days a week, but assumes no obligation to do so.
MK2 may therefore interrupt access to the Site without notice, particularly for maintenance and upgrade operations, or for any other reason, including technical ones.
MK2 is in no way responsible for these interruptions or for any consequences that may result for the User or any third party.
Please note that MK2 may terminate or modify the features of the Site at any time, without notice.
Furthermore, the User declares and warrants that they are fully aware of the characteristics and constraints of the Internet, and in particular that data and information transmissions over the Internet only benefit from relative technical reliability, as they circulate on heterogeneous networks with varying technical characteristics and capacities, which may disrupt access or sometimes render it impossible.
The User acknowledges that MK2 or its suppliers shall in no event be held liable for any material and/or immaterial, direct and/or indirect damage of any nature whatsoever arising from the use or inability to use the Site.
Except where mandatory legal provisions state otherwise, MK2 is not liable and cannot be held responsible in any capacity whatsoever for the following, without this list being exhaustive:
- software operation,
- transmission of any data and/or information over the Internet,
- cases of force majeure as interpreted by French courts and tribunals,
- interruption of access networks or networks accessible via the Site,
- failure of receiving equipment or telephone lines,
- computer viruses circulating on the Internet that could affect the Site,
- interruption of Site activity.
Furthermore, any non-compliant use of the Site is at the User's own risk, and MK2 shall not be liable for any damage or data loss suffered by the User's equipment.
MK2 shall not be held liable in the event of legal proceedings brought against the User and/or their representatives as a result of their use of the Site.
The User is liable to MK2 and/or third parties for any material and/or immaterial, direct and/or indirect damage of any nature whatsoever caused by the User during their use of the Site.
It is the User's responsibility to take all appropriate measures to protect their own data and/or software from contamination by any viruses circulating on the Internet.

8 – GOVERNING LAW – DISPUTES – MEDIATION
Governing Law and Complaint Handling
These Terms of Use are governed by French law. Any dispute relating to the application, interpretation, or execution of these terms shall be subject to the jurisdiction of the French courts. The Customer and MK2 will first endeavor to seek an amicable resolution. To this end, the Customer must first notify MK2 of the subject of their complaint by registered letter with acknowledgment of receipt to the following address:
